Terms of Service
These Terms govern use of the OBA Cookies website and purchases or requests made through Olly’s Baked Assortments. By using the site or placing an order, you agree to the terms that apply to that activity.
1. About OBA
Olly’s Baked Assortments, also known as OBA Cookies, is a home-based cottage bakery in La Mesa, California. OBA offers small-batch baked goods through channels that may include online ordering, neighborhood Grab-N-Go through Bertha, local pickup or delivery, California shipping for eligible products, farmers markets, pop-ups, and events.
2. Website Use
You may use this website for lawful personal or business inquiries and to access OBA’s available services. You may not interfere with site operation, attempt unauthorized access, misuse checkout or account systems, submit fraudulent orders, or use automated or abusive activity that disrupts the website or OBA’s operations.
3. Products, Pricing, and Availability
Cookies are produced in limited batches. Flavors, quantities, pack options, prices, and availability may change. Bertha neighborhood pricing, online pricing, and market/event pricing may differ. The current cart and checkout total are the controlling prices for an online order before payment is submitted.
Specialty cookies may carry different pricing or pack upcharges. Custom Feast pricing depends on the order details and is not confirmed merely by submitting an inquiry.
4. Orders and Payment
The website checkout is currently using Square’s sandbox environment for testing, so a sandbox checkout does not create a live paid order. Until production online payments are enabled, an order is complete only when OBA provides an applicable confirmation through an available ordering method. Once live website payments are enabled, an online order will not be complete until the website accepts the order and payment is successfully processed or another confirmation is provided by OBA. OBA may decline or cancel an order when necessary because of inventory, production constraints, payment problems, suspected fraud, incorrect pricing or technical errors, fulfillment limitations, or other operational issues.
OBA is integrating Square’s payment technology for online card payments. The current Square checkout is a sandbox test environment rather than a live production payment service. When production online card payments are enabled, use of Square-supported payment functionality may also be subject to Square’s applicable terms and privacy practices.
5. Pickup, Delivery, and Shipping
Available fulfillment options are shown during ordering and checkout. Local delivery is available only for qualifying orders and locations, and applicable delivery fees are calculated based on the delivery information provided. Eligible cookie orders may be shipped to addresses within California; shipping outside California is not currently available.
Customers are responsible for providing accurate contact and fulfillment information and for following the pickup, delivery, or shipping instructions associated with their order.
6. Changes, Cancellations, and Refunds
Need to change an order? Contact OBA as soon as possible. Changes are not guaranteed and depend on production status, ingredient and cookie availability, and current stock.
Preorders may be cancelled for a full refund before preorders close at 9 PM on Friday. After the preorder window closes, the order is committed to that week’s production, so cancellations and refunds are not guaranteed. If circumstances arise, contact OBA as soon as possible and we will do our best to help.
7. Missed Pickup
If you miss your scheduled pickup, OBA will generally hold your cookies through the applicable Cookie Drop pickup period shown or communicated for that order. After that period, unclaimed orders may no longer be available. Contact OBA as soon as possible if you expect to be late or need additional time.
8. Food Allergens and Product Information
OBA Cookies are prepared in a home kitchen where common allergens are used, including wheat/gluten, dairy, and eggs. Individual products may contain additional allergens such as peanuts or tree nuts. Cross-contact is possible, and OBA cannot guarantee that any product is completely free from cross-contact with allergens.
Customers with food allergies or dietary concerns should review the ingredient and allergen information provided for the specific product and contact OBA before ordering if additional information is needed.
9. Custom Orders, Events, and Collaborations
Submitting a Custom Feast, custom-order, market, pop-up, event, or collaboration inquiry does not create a confirmed order, reservation, vendor commitment, or booking. OBA will confirm availability, scope, pricing, payment requirements, and other applicable details separately.
10. Accounts and Authorized Access
Cookie Crew tools are restricted to authorized OBA staff. You may not attempt to access Crew accounts, administrative functions, or protected systems without authorization.
Longneck customer accounts are planned but have not launched. Guest ordering remains separate from those future account features. Additional account-specific terms may be added before customer accounts become available.
11. Intellectual Property
OBA’s original website content, branding, names, logos, character designs, artwork, photography, written materials, product names, and other original creative materials are owned by OBA unless otherwise stated. Third-party names, marks, content, and materials remain the property of their respective owners and are used only as permitted. Nothing in these Terms grants permission to reproduce or commercially exploit OBA intellectual property without authorization.
12. Third-Party Services and Links
The website may use or link to third-party services such as payment processors, maps, analytics, social platforms, or other providers. OBA does not control third-party websites or their independent terms, availability, security, or privacy practices.
13. Website Availability and Disclaimers
OBA works to keep website information and functionality accurate and available, but the site may occasionally contain errors, experience downtime, or require updates. To the extent permitted by applicable law, the website and its content are provided without a guarantee that access will always be uninterrupted or error-free.
Nothing in these Terms excludes rights or remedies that cannot legally be excluded.
14. Limitation of Liability
To the extent permitted by applicable law, OBA will not be liable for indirect, incidental, special, or consequential losses arising solely from use of the website or inability to access it. This provision does not limit liability where such a limitation is prohibited by law.
15. Governing Law
These Terms are governed by the laws applicable in the State of California, without overriding any consumer protection or other rights that apply to you under applicable law.
16. Changes to These Terms
OBA may update these Terms as the website, ordering system, and services evolve. The effective date at the top of this page identifies the current published version. Material new features may require additional or revised terms before they launch.
